For those interested in constitutional theory and constituent power, check Carl Schmitt's book entitled "Constitutional Theory"..

The book was published in 1927 and translated from German into English in 2008.

"The will of the people to provide themselves a constitution can only be made evident through the act itself and not through observation of a normatively regulated process. Self-evidently, it can also not be judged by prior constitutional laws or those that were valid until then." (p. 131).

Occupied Palestinian Territory: Social Contract under Occupation?

In a situation of persistent exceptional rules, military occupation & limited autonomy, the social contract has first of all an ambivalent nature. Knowledge is placed under domination, Zionists are making out of Palestine a “vanishing landscape”, the borders have not been drawn and the national resources are out of national control, in addition the PA does not represent ALL Palestinians. All that makes the autonomy illusory. Above all, this political asymmetry makes the social contract absolutely ambivalent..

Possible Alternative:

a move back to the roots of the Palestinian struggle for justice & equality... we need a new movement to ensure the organization and systematization of a knowledge that is already present in the masses & to advance the replacement of former conditions with a new collective will based on rights and not on political motives and the narrow interests of this or that faction!..

Radbruch Formula

Laws that contradict the fundamental pleas for justice are not valid law, but constitute “legal injustice”. One has to dispute the legal nature of such laws, and one is not required to obey these laws. (Radbruch formula).

Human dignity represents the “core” of the demands of the revolting masses in the Arab World.. The demand for dignity contains an appeal to treat ALL citizens as equals since human dignity means equal dignity for all humans… Human dignity forms the fundamental and indispensable standard of legitimacy of the new social and political order & this new order cannot be reversed, even when the reactionary forces and traditional regimes (Saudi Arabia & Co.) are trying their best to prevent this from happening.
